Costco goes to court over Wheaton gas sales denial | News
WHEATON, Md. (WUSA9) -- Montgomery County attorneys will be in court Friday trying to keep big box retailer, Costco from opening up a huge gas station in Wheaton.
It's a fight that has been going on for a while and one that was thought to be over back in March.
Costco was denied their bid by the Montgomery County Board of Appeals to open a 16-pump gas station in Wheaton. Residents in the area have environmental concerns. They say all the cars idling would hurt the air quality of the people living in the area.
Earlier this year it was believed that that was the end of a more than five year fight between the two. However Costco has not given up yet and will be in court Friday to argue a different strategy.
They are arguing preemption and saying the air quality standards are actually designed to regulate large power plants. So to deny their bid quote is "arbitrary and not supported by substantial evidence.
